These Terms of Service ("Terms") govern your use of the services provided by Gera Services ("Gera", "we", "us", "our") through our website at gera.services and any related channels. By engaging our services or accessing our website, you agree to be bound by these Terms.
These Terms are governed by the laws of England and Wales. GeraCast subscribers are additionally governed by the GeraCast Terms of Service Addendum, which supplements these Terms and takes precedence for GeraCast-specific matters.
Gera provides AI-powered business services, which may include:
The specific scope of services for each engagement will be agreed in writing prior to commencement of work ("Project Agreement").
GeraCast transcribes your podcast episodes using AI and generates structured content — show notes, social media posts, chapter markers, platform descriptions, and pull quotes — delivered as a content pack. This is an automated, AI-driven service with no human editorial review of individual episodes unless explicitly agreed.
Your episode submissions are processed by third-party AI services:
| Sub-processor | Role |
|---|---|
| OpenAI (Whisper API) | Audio transcription |
| Anthropic (Claude API) | Content generation |
| Google (Docs / Drive API) | Output delivery and formatting |
AI output is not guaranteed to be accurate. You must review all Output before publishing. We do not use your audio to train AI models.
| Data type | Retention period |
|---|---|
| Audio files (uploaded or accessed via URL) | Deleted within 30 days of Episode Submission |
| Transcripts (intermediate processing data) | Deleted within 30 days of Episode Submission |
| Generated Output | Retained for 90 days after delivery |
| Account and billing data | Duration of subscription + 6 years (HMRC) |
How to cancel: Email gera.services.uk@gmail.com or use your account dashboard. Please give 14 days' notice. Cancellation takes effect at the end of the current billing period following the notice period. No refund is issued for fees already paid in the current billing period, except as required by law.
Consumer right to cancel: If you are an individual consumer, you have a statutory right to cancel within 14 days of sign-up under the Consumer Contracts Regulations 2013.
You may only submit genuine podcast episodes that you own or have the legal right to submit. You must not submit episodes that infringe third-party intellectual property or privacy rights. We may suspend or terminate your account immediately for breach of this requirement.
An engagement begins when we confirm acceptance of your request in writing, or when we begin work — whichever is earlier. We reserve the right to decline any request at our discretion. Quotes are valid for 14 days unless otherwise stated.
All fees are quoted exclusive of VAT unless stated otherwise. Project invoices are due within 14 days of the invoice date. GeraCast subscriptions are billed monthly in advance. We reserve the right to charge interest on overdue amounts at 8% per annum above the Bank of England base rate (Late Payment of Commercial Debts (Interest) Act 1998).
Upon receipt of full payment, Gera assigns to you all intellectual property rights in any deliverables created specifically for you. We retain ownership of pre-existing tools, templates, processes, and methodologies ("Background IP"). You grant us a limited licence to use materials you provide solely for delivering the services.
Each party agrees to keep confidential any information received from the other that is designated as confidential or reasonably understood to be so. Confidentiality obligations survive termination for 3 years.
You agree to provide accurate and sufficient information required to deliver the services. You are responsible for ensuring your use of deliverables complies with applicable laws. For GeraCast, you are responsible for ensuring you have all necessary rights to submit audio content for processing.
Our total liability in connection with any engagement shall not exceed the total fees paid by you in the 12 months preceding the claim. We are not liable for indirect or consequential loss, loss of profit, loss of data, or damage to reputation. We do not guarantee AI-generated outputs are free from error — you are responsible for reviewing all deliverables before use.
For project-based engagements: either party may terminate by giving 7 days' written notice. Either party may terminate immediately if the other commits a material breach and fails to remedy it within 14 days of written notice, or becomes insolvent.
These Terms are governed by the laws of England and Wales. The courts of England and Wales shall have exclusive jurisdiction over any disputes. Before commencing formal proceedings, both parties agree to attempt to resolve disputes informally in good faith within 30 days.
These Terms, together with any Project Agreement and (for GeraCast) the GeraCast Addendum, constitute the entire agreement between the parties. If any provision is found to be unenforceable, the remaining provisions continue in full force.
